Wills

You may deposit your Last Will and Testament for safekeeping with the Register in Probate for a fee of $10. Any will deposited in this manner will remain on file until withdrawn by the testator or for purposes of probate.

A Last Will and Testament filed for safekeeping is not a public record.

If a decedent leaves a Last Will and Testament but there is not a need to commence a probate action, their Last Will and Testament must still be filed with the Register in Probate together with a Non-Probate of Filed Will Affidavit.

You can download a Non-Probate of Filed Will Affidavit form below.

Section 856.05 of the Wisconsin Statutes governs the delivery of wills to the court.
